Terms and Conditions for WILD RIDE RENTAL

Please read these Terms and Conditions ("Terms") carefully before using the wildride.rentals website (the "Service") and renting a motorcycle from WildRideRental ("the Company," "we," "us," or "our").

This agreement is governed by Spanish law, including the provisions of the Spanish Civil Code, the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007), and other applicable regulations.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Parties to the Agreement

  • The Company: WildRideRental, a company registered in Spain with registration number B21783204, having its registered office at Carrer de Parcerisa, 25, Barcelona 08014, and contact email wildridemotorcycle@gmail.com.
  • The Renter: The individual ("you," "your," "the Renter") who completes the booking process and is named on the rental agreement.

2. Rental Requirements

To rent a motorcycle from the Company, the Renter must meet the following requirements:

  • Minimum Age: Be at least 21 years of age. Certain motorcycle models may have a higher age requirement.
  • Driving License: Possess a valid, original driving license recognized in Spain for the category of motorcycle being rented. For non-EU/EEA citizens, an International Driving Permit (IDP) may be required in addition to the national license. The license must have been held for a minimum of 2 years.
  • Identification: Provide a valid passport or national ID card.
  • Payment Method: Have a valid credit card in the Renter's name to pay for the rental and the security deposit.

The Company reserves the right to refuse a rental if the Renter does not meet these requirements or appears to be under the influence of alcohol or drugs.

3. Booking, Payment, and Security Deposit

  • Booking: Bookings can be made through our website. A booking is confirmed only after you receive a confirmation email from us.
  • Payment: The full rental price must be paid at the time of booking or upon collection of the motorcycle, as specified during the booking process.
  • Security Deposit: A security deposit is required upon collection of the motorcycle. This will be pre-authorized on the Renter's credit card. The deposit will be released within 7-14 business days after the motorcycle is returned in the same condition it was rented, subject to deductions for damages, fines, or other charges.
  • Included in Price: The rental price includes the motorcycle, third-party liability insurance as required by Spanish law, unlimited mileage (or specify limit), two helmets, and VAT (IVA).
  • Not Included in Price: The price does not include fuel, fines, tolls, additional insurance, or any accessories not explicitly mentioned as included.

4. Cancellation Policy

  • Cancellations made more than 30 days before the rental start date will receive a full refund.
  • Cancellations made between 15 and 30 days before the rental start date will be charged 50% of the total rental price.
  • Cancellations made less than 15 days before the rental start date are non-refundable.
  • No-shows will be charged the full rental amount.

5. Renter's Obligations

The Renter agrees to:

  • Use the motorcycle responsibly and in accordance with Spanish traffic laws.
  • Not use the motorcycle for racing, off-road activities (unless explicitly permitted for a specific model), or any illegal purpose.
  • Ensure the motorcycle is securely parked and locked when not in use. The provided anti-theft device must be used.
  • Not carry more passengers than the motorcycle is legally certified for.
  • Return the motorcycle at the agreed date, time, and location specified in the rental agreement. Late returns will be charged at a daily rate plus an administrative fee.
  • Return the motorcycle with the same level of fuel as when it was collected. A refueling charge plus the cost of fuel will apply if not returned with the correct amount.
  • Inform the Company immediately of any accident, theft, or damage to the motorcycle.

6. Insurance

  • Standard Insurance: All motorcycles are covered by third-party liability insurance as mandated by Spanish law. This covers damages or injuries to third parties.
  • Damage Waiver: The Renter is responsible for any damage to, or theft of the motorcycle.
  • Optional Insurance: Additional insurance options to reduce the Renter's liability may be available for purchase at the time of rental. Including loss damage Waiver with an excess of EUR 2500.

7. Accidents, Theft, and Fines

  • Accidents: In case of an accident, the Renter must immediately contact the police and the Company. The Renter must complete an accident report form ("Declaración Amistosa de Accidente") and not admit liability.
  • Theft: In case of theft, the Renter must report it to the police immediately and provide the Company with a copy of the police report and the motorcycle keys.
  • Traffic Fines: The Renter is responsible for all traffic fines and penalties incurred during the rental period. The Company will charge an administrative fee for handling each fine, in addition to the fine itself.

8. Data Protection

In compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Data Protection, we inform you that your personal data will be processed by WildRideRental for the purpose of managing your rental agreement. You have the right to access, rectify, delete, and object to the processing of your data by contacting us at wildridemotorcycle@gmail.com.

9. Governing Law and Jurisdiction

These Terms and the rental agreement shall be governed by and construed in accordance with the laws of Spain. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

10. Modifications to Terms

The Company reserves the right to modify these Terms at any time. The Terms in effect at the time of your booking will apply to your rental.
